§ 38-309. Final action on permit application; authority of director.

  • (a)

    The POTW director/superintendent shall take final action on all applications for wastewater permits not later than 90 days following receipt of a complete application.

    (b)

    The POTW director/superintendent is authorized to:

    (1)

    Issue a significant industrial user permit containing such conditions as are necessary to effectuate the purposes of this article and G.S. 143-215.1.

    (2)

    Issue a significant industrial user permit containing time schedules for achieving compliance with applicable pretreatment standards and requirements.

    (3)

    Modify any permit upon not less than 60 days' notice and pursuant to section 38-311.

    (4)

    Revoke any permit pursuant to section 38-224(a).

    (5)

    Suspend a permit pursuant to section 38-224(a).

    (6)

    Deny a permit application when in the opinion of the POTW director/superintendent such discharge may cause or contribute to pass-through or interference with the wastewater treatment plant or where necessary to effectuate the purposes of G.S. 143-215.1.
